General Terms and Conditions of Sale
This English version is provided for convenience. In case of discrepancy, the French version prevails.
General terms and conditions of sale of the products sold on FLASH TONER
Article 1 - Purpose
These terms and conditions govern the sale by FLASH TONER, a simplified joint-stock company (SAS) with a share capital of €1,000, SIRET 939084000, registered office: 60 Rue François 1er, 75008 Paris, of office and IT products.
Article 2 - Prices
The prices of our products are shown in euros including all taxes (VAT and other taxes applicable on the date of the order), unless otherwise stated and excluding handling and shipping costs.
If you order for delivery to a country other than mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and amounts are not the responsibility of FLASH TONER. They will be borne by you and are your responsibility, both in terms of declarations and of payments to the competent authorities and bodies of your country. We advise you to seek information on these matters from your local authorities.
All orders, whatever their origin, are payable in euros. FLASH TONER reserves the right to change its prices at any time, but the product will be invoiced on the basis of the price in force when the order is confirmed and subject to availability. The products remain the property of FLASH TONER until the price has been paid in full. Please note: as soon as you take physical possession of the products ordered, the risks of loss of or damage to the products are transferred to you.
Business customers established in another European Union Member State (Belgium, the Netherlands, Luxembourg).
Prices are invoiced exclusive of VAT, without French VAT: VAT is reverse-charged by the customer (Article 196 of Directive 2006/112/EC; triangular transaction, Articles 141 and 197 of the same Directive, where the goods are shipped from a Member State other than France). The customer's EU VAT number, from the delivery country, is checked on the EU VIES register and shown on the invoice. The customer guarantees that this number is correct and that it is a VAT-registered business; otherwise, the applicable VAT is due and will be invoiced to the customer.
Article 3 - Orders
You can place an order:
-
Online: www.flashtoner.fr
The contractual information is presented in French and will be confirmed no later than when your order is confirmed. FLASH TONER reserves the right not to record a payment and not to confirm an order for any reason whatsoever, in particular in the event of a supply problem or a difficulty concerning the order received.
Article 4 - Confirmation of your order
Any order placed on the website www.flashtoner.fr implies acceptance of these General Terms and Conditions. Any order confirmation entails your full and complete acceptance of these general terms and conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of them. The order confirmation will constitute signature and acceptance of the transactions carried out. A summary of your order information and of these General Terms and Conditions will be sent to you in PDF format at the e-mail address used to confirm your order.
Article 5 - Payment
Confirming your order creates an obligation to pay the total amount shown. Available payment methods and the information needed to complete payment are displayed during checkout.
Payment with Amazon Pay
When Amazon Pay is offered at checkout, you can use the payment methods associated with your Amazon account. Payment is processed by Amazon Payments Europe S.C.A. Your purchase contract remains with FLASH TONER, which handles your order, delivery and after-sales service.
Cancellation, return and refund requests should be sent to FLASH TONER (“Request a return” form in your customer account, or contact@flashtoner.fr), in accordance with articles 6 and 9 of these terms and your applicable statutory rights. Refunds for payments made with Amazon Pay are processed through Amazon Pay to the payment method used for the original transaction.
Article 6 - Returns (right of withdrawal)
In accordance with articles L221-18 et seq. of the French Consumer Code, you have 14 days from receipt of your order to return a product to us, without having to give any reason or pay any penalty. As a commercial gesture, this period also applies to business customers.
Condition of the product.
Only new, unopened and unused products, in their original sealed packaging and complete (accessories, instructions), can be returned. A consumable (toner, cartridge, drum…) whose packaging has been opened can no longer be resold as new: it can neither be taken back nor refunded under the right of withdrawal (see the exceptions below).
How to proceed.
Submit your request from your customer account, section “Request a return”: choose the order, the product and the reason. The answer is displayed immediately, with a return number (RMA) and the return address. Without a customer account (guest order), write to contact@flashtoner.fr stating your order number. Please do not send anything back without an RMA number: an unannounced parcel may be refused or delayed.
Costs and shipping.
Return costs are borne by you (article L221-23 of the French Consumer Code). Write the RMA number on the shipping box and protect the product. It travels at your own risk: choose a tracked shipment and keep the proof of postage. A product damaged during the return may prevent the refund. If the return results from an error on our part or a defect, article 9 applies and the costs are borne by us.
Refund.
We refund the price of the product and the initial delivery costs (based on the standard delivery method) no later than 14 days after your request, using the payment method used for the order. We may withhold the refund until we receive the product or your proof of shipment (article L221-24 of the French Consumer Code).
Exceptions.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to:
- goods made to your specifications or clearly personalised;
- goods liable to deteriorate or expire rapidly;
- goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection;
- audio or video recordings and computer software unsealed after delivery;
- services fully performed before the end of the withdrawal period, with your prior express consent and your waiver of this right.
Article 7 - Availability
Our products are offered for as long as they are visible on the website www.flashtoner.fr and while stocks last. For products not held in stock, our offers are valid subject to availability from our suppliers. If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no payment will be debited.
Article 8 - Delivery
The products are delivered to the delivery address given during the ordering process, within the time shown on the order confirmation page. In the event of a shipping delay, an e-mail will be sent to you to inform you of any consequence for the delivery time indicated to you.
For deliveries by a carrier, FLASH TONER cannot be held liable for a delivery delay due exclusively to the customer's unavailability after several appointments have been offered.
Delivery area.
We deliver to mainland France, Belgium, the Netherlands and Luxembourg. Outside France, delivery is for VAT-registered businesses only: company name and a valid EU VAT number of the delivery country are required. Shipping to Belgium, the Netherlands and Luxembourg: €9.90 excl. VAT per order, free from €149 excl. VAT; indicative lead time 3 to 5 working days. Canon and HP A4 paper can be delivered to Belgium, the Netherlands and Luxembourg. In Luxembourg, only a selection of items can be delivered (including this paper); the site shows this before the order is placed. Other paper items, packaging, pallets and items from the "Les bonnes affaires" section are delivered in France only.
Article 9 - Warranty (defective, non-conforming or damaged product)
A product that is defective, different from the one ordered (wrong reference or shipping error) or damaged on delivery is taken back, repaired, exchanged or refunded. Return costs are then borne by FLASH TONER.
Private customers (consumers).
You benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) for 2 years from delivery. During this period, the defect is presumed to have existed at the time of delivery. You may choose between repair and replacement of the product (article L217-9). Failing that, you may obtain a price reduction or the cancellation of the sale (article L217-14). You also benefit from the warranty against hidden defects (articles 1641 et seq. of the French Civil Code): the action must be brought within 2 years of discovering the defect (article 1648). You may then choose between cancellation of the sale and a price reduction.
Business customers.
Any claim for a defect, non-conformity or delivery error must reach us within 30 days of delivery. After this period it can no longer be accepted, except where mandatory legal provisions apply.
Damaged parcel.
On delivery, check the condition of the parcel in the presence of the delivery person. If it is damaged, record precise reservations on the delivery slip or refuse the parcel. Report the problem to us promptly, preferably within 48 to 72 hours, with photos of the box and the product: a late report makes recourse against the carrier more difficult.
How to proceed.
Submit your request from your customer account, section “Request a return”, reason “Defective product”, “Wrong product received” or “Damaged parcel or product”. Describe the problem and attach at least one photo. For a print defect, photograph a printed page showing the problem, as well as the product label. We reply within 2 working days. Do not send anything back before our reply: we will tell you how to proceed and give you the RMA number. Without a customer account, write to contact@flashtoner.fr.
Statutory notice (French law) – legal guarantee of conformity
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;

English translation (for information only)
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all the updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the reconditioned goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code (code de la consommation).
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code (code civil), for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.
Article 10 - Liability
The products offered comply with the French legislation in force. FLASH TONER cannot be held liable for any failure to comply with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities whether the products you intend to order may be imported or used.
Article 11 - Applicable law in the event of disputes
These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction.
Article 12 - Intellectual property
All the elements of the website www.flashtoner.fr are and remain the exclusive intellectual property of FLASH TONER. Any partial or total reproduction is strictly prohibited.
Article 13 - Personal data
In accordance with the French law of 6 January 1978, you have a right of access to, rectification of and objection to the personal information concerning you.
Article 14 - Archiving and proof
FLASH TONER will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy. The computerised records will be considered as proof of the transactions between the parties.
